This Week in the Senate: 2/25/2019

This week, the Senate is holding votes on a bill and a few nominations, and the Judiciary Committee might meet to vote on Neomi Rao's nomination to the D.C. Circuit and two PCLOB nominees. The latter situation is very fluid, as seen with this Axios report.

On the floor, the Senate will vote at 5:30 pm to invoke cloture on the motion to proceed to S. 311, the Born-Alive Abortion Survivors Protection Act. Due to the controversial nature of the legislation, the motion will likely not garner the necessary 3/5ths majority needed to proceed to the motion to proceed, so the body will then vote on a cloture motion for the nomination of Perkins Coie partner Eric Miller to a Ninth Circuit seat in Washington. Miller does not enjoy the support of either of his home state senators, who are both Democrats, and thus this vote will likely be along party lines.

The Senate is also voting on the nominations of Michael J. Desmond to be Chief Counsel for the IRS, Andrew Wheeler to be Administrator of the EPA, and former RNC General Counsel John L. Ryder to be a member of the Tennessee Valley Authority's Board of Directors, all of whom will probably be confirmed.

On Thursday, the Judiciary Committee might will hold an executive session to vote on and/or hold over the following nominations (the number in the parentheses appearing after the nominee's name signifies whether this is the first or second time appearing on the agenda; first-time appearances are typically held over and nominees appearing for the second time usually receive votes):

Court of Appeals:
  1. Neomi Rao, to be a U.S. Circuit Judge for the D.C. Circuit (2)
  2. Joseph Bianco, to be a U.S. Circuit Judge for the Second Circuit (1)
  3. Michael H. Park, to be a U.S. Circuit Judge for the Second Circuit (1)
District Court:
  1. Greg G. Guidryto be a U.S. District Judge for the Eastern District of Louisiana (1)
  2. Michael T. Liburdito be a U.S. District Judge for the District of Arizona (1)
  3. Peter D. Welteto be a U.S. District Judge for the District of North Dakota (1)
    Privacy and Civil Liberties Oversight Board:
    1. University of Virginia School of Law professor Aditya Bamzai (R, 2)
    2. Cooley partner Travis LeBlanc (D, 2)
    Department of Justice:
    1.  Drew H. Wrigley, to be United States Attorney for the District of North Dakota (1)
    Rao's nomination is controversial and appears to be in danger of not getting a majority of the Committee's support, so she may be held over without a vote.

    The Senate might also consider the reported Rules Committee resolution changing postcloture time rules, but that has not been formally scheduled.
